Reserve
Collection Guidelines: Copyright
Photocopied material must be handled
in compliance with the "Fair Use" provisions
of the copyright law (Section 107, Title
17 U.S. Code). Although the law does
not specifically address the use of photocopies
in library reserve collections, current
interpretation suggests that reserve
collections adhere to the same principles
which apply to copying for classroom
distribution.
Copyright guidelines
- Photocopies of journal articles or
a chapter from a book may be placed
on reserve for one semester only without
permission from the publisher.
- Permission must be obtained from
the publisher (including the payment
of specified royalties) in order to
place copies of any item on reserve
for each additional semester.
Procedure for obtaining permission
from the publisher
- Smith Library Center is registered
with the Copyright Clearinghouse Center
(CCC), an online service for securing
copyright permission.
- Circulation Services staff will request
permission to place hotocopied items
on reserve through the CCC. Royalty
fees will be paid through the CCC and
absorbed by the library. If the fee
for an item is determined to be excessive
a Circulation Services staff member
will contact you to see if another
article might be substituted for the
one in question.
- If a publisher is not registered
with the CCC permission must be obtained
from the publisher by letter. The library
will provide a permission request form
for you to fill out. We will submit
the completed form to the
publisher.
- If you know that you will be placing
a photocopy on reserve for more than
one semester please notify Circulation
Services as soon as possible. We cannot
accept an item for an additional semester
without permission and if a publisher
is not registered with the CCC some
time may be involved before the necessary
permission can be secured. Items requiring
copyright permission for placement
on Reserve in the Fall semester should
be submitted by August 15. Spring semester
items requiring copyright permission
should be submitted by December 15.
- All photocopied items placed on reserve
will be stamped with notification of
copyright.
